Subject: Information notice on the processing of your personal data, pursuant to art. 13 of Italian Legislative Decree 196/03 concerning the protection of personal data.

With reference to the new Consolidated Privacy Act introduced by Legislative Decree no. 196 of 2003 and in force since 1 January 2004, our Company confirms its commitment to processing the personal data of all the parties it comes into contact with in the course of its business activity in accordance with the principles of fairness, lawfulness, transparency and protection of confidentiality, as well as with the new legal provisions established to safeguard these principles. To this end, the undersigned Company informs you that, for the establishment and performance of the ongoing contractual relationships with you, it holds personal and tax data acquired, including verbally, directly or through third parties, relating to you, data classified as personal by law. With reference to this data, we inform you that:

Purpose of the processing

The data is processed in relation to contractual requirements and the consequent fulfilment of the legal and contractual obligations deriving therefrom, as well as to achieve effective management of business relationships. In particular, the personal data provided by the data subject is essential for the analysis and assessment activity aimed at obtaining financing. It will be used for the management of the contractual relationship as well as for the fulfilment of the legal obligations established in financial matters. It will also be possible to process the data for the protection of credit, for statistical purposes, for market analysis and surveys, for promotional activities, for measuring the degree of customer satisfaction and for the commercialisation of the data itself.

Method of processing

The data will be processed in written form and with the aid of electronic means. The processing will be carried out by Roberto Serra personnel and/or by personnel of firms or companies connected to it under agency contracts or professional service assignments, or by other parties appointed in any way.

Provision of data

The provision of this data is mandatory for everything required by legal and contractual obligations and therefore any refusal to provide it or to its subsequent processing may make it impossible for the undersigned to carry out the contractual relationships themselves. The failure to provide all data that is not attributable to legal or contractual obligations will instead be assessed on a case-by-case basis by the undersigned and will determine the consequent decisions in proportion to the importance of the requested data with respect to the management of the business relationship.

Disclosure of data

Without prejudice to the communications and disclosures made in fulfilment of legal obligations, and also for the purposes of credit protection and the better management of our rights relating to the individual business relationship, the data may be disclosed in Italy and/or abroad to: – our network of collaborators – factoring companies – professionals and consultants – companies operating in the transport sector. The data will be processed for the entire duration of the contractual relationships established and also subsequently for the fulfilment of all legal obligations as well as for future commercial purposes.

Rights of the data subject

In relation to this data, you may exercise the rights set out in art. 7 of Legislative Decree no. 196/2003 within the limits and under the conditions established by articles 8, 9 and 10 of the aforementioned legislative decree.

Art. 7 – (Right of access to personal data and other rights)

1. The data subject has the right to obtain confirmation as to whether or not personal data concerning them exists, even if not yet recorded, and its communication in intelligible form.
2. The data subject has the right to be informed of:
a) the origin of the personal data;
b) the purposes and methods of the processing;
c) the logic applied in the case of processing carried out with the aid of electronic instruments;
d) the identification details of the controller, the processors and the representative designated pursuant to article 5, paragraph 2;
e) the parties or categories of parties to whom the personal data may be disclosed or who may become aware of it as a designated representative within the territory of the State, as processors or appointees.
3. The data subject has the right to obtain:
a) the updating, rectification or, where there is an interest, the integration of the data;
b) the erasure, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is not necessary in relation to the purposes for which the data was collected or subsequently processed;
c) confirmation that the operations referred to in letters a) and b) have been brought to the knowledge, also as regards their content, of those to whom the data was communicated or disclosed, except in the case where this fulfilment proves impossible or involves the use of means manifestly disproportionate to the protected right.
4. The data subject has the right to object, in whole or in part:
a) on legitimate grounds, to the processing of personal data concerning them, even though pertinent to the purpose of the collection;
b) to the processing of personal data concerning them for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication.
